Robert Bork Nomination Fight Altered Judicial Selection

WASHINGTON -- Conservatives wanted Robert H. Bork on the Supreme Court. They wound up with Anthony Kennedy, the key vote in reaffirming a woman's right to an abortion.

The fight over Bork's failed Supreme Court nomination redefined the Senate confirmation process and made him a symbol of the nation's culture wars. The political battle that erupted over Bork has now, years later, expanded to stall nominees for far lesser judicial posts, and nominees themselves have curbed their responses to questioning to avoid his fate.

Had Bork, who died Wednesday at age 85, prevailed and become a justice, his vote would have dramatically changed the court.

President Ronald Reagan's choice of Bork in 1987 to replace Justice Lewis Powell was intended to cement conservative control of the court for decades. And Bork gave both his supporters and opponents every reason to believe, through scholarly writings and judicial decisions, that he would be a consistent conservative vote on a range of key issues. That would include, perhaps most importantly, one day delivering the decisive blow to undo the 1973 Roe v. Wade ruling that declared a woman's right to an abortion.

He was a staunch critic of the court's Griswold v. Connecticut decision in 1965 that found a right to privacy in the Constitution that trumped a state law prohibiting even married couples from using birth control. The ruling was a precursor to decisions in favor of abortion rights and gay rights, including some authored by Kennedy.

In the mid-1980s, Bork was better known and had a much longer legal resume than his conservative colleague on the federal appeals court in Washington, Antonin Scalia. Bork had been a Yale law professor, whose students included Bill Clinton and Hillary Rodham.

He was the Nixon administration's top Supreme Court lawyer and played a dramatic role in the Watergate scandal's Saturday Night Massacre. When Attorney General Eliot Richardson and his deputy, William Ruckelshaus, refused President Richard Nixon's order to fire Watergate special prosecutor Archibald Cox, Richardson resigned and Ruckelshaus was fired. The next in line at the Justice Department, Solicitor General Bork complied and earned the enmity of many Nixon opponents, although Richardson himself later praised Bork for his actions.

In 1986, Chief Justice Warren Burger's retirement gave Reagan the chance to elevate Justice William Rehnquist to chief justice and fill Rehnquist's seat. Bork and Scalia were strong contenders and shared the "originalist" view that judges should focus on the meaning of the Constitution and laws as they were understood at the time they were written

Reagan went with Scalia, nine years younger than Bork and also the first Italian-American on the Supreme Court. With most attention focused on Rehnquist, Scalia sailed to confirmation through a Republican-controlled Senate.

But by the time of Powell's retirement, a year later, control of the Senate had shifted to the Democrats and control of the court was at stake. On the same day Reagan said he would nominate Bork, Sen. Edward Kennedy rushed to the Senate floor to paint a vivid picture of Bork that enraged the White House and signaled the coming confirmation battle.

"`Robert Bork's America is a land in which women would be forced into back-alley abortions, blacks would sit at segregated lunch counters, rogue police could break down citizens' doors in midnight raids, schoolchildren could not be taught about evolution, writers and artists could be censored at the whim of the government and the doors of the federal courts would be shut on the fingers of millions of citizens," Kennedy said.

The Senate had scuttled four high court nominations in the 20 years before Bork's: two Democratic picks, Abe Fortas and Homer Thornberry, and two Republican ones, Clement F. Haynsworth Jr. and G. Harrold Carswell. But the fight over Bork was intensely partisan and ideological, and it reflected the high stakes in the Reagan administration's effort to push the federal judiciary to the right.

The American Civil Liberties Union dropped more than a half-century of neutrality in confirmations to oppose Bork. Liberal interest groups mobilized in a precursor to what is now standard practice on both the left and right, to fight the nomination. Actor Gregory Peck recorded anti-Bork commercials.

The Senate hearings were in one sense a televised civics lesson: Bork, a burly man with a heavy beard, repeatedly defended ? in dry scholarly terms ? his view that judges should play a limited role in American life. He faced sustained Democratic attacks on his writings in academia and on the federal bench.

Among the topics up for discussion were Bork's views on civil rights. In 1963, he had written disapprovingly of the pending Civil Rights Act and called the government's effort to stop discrimination in restaurants, hotels and other areas of public accommodation "a principle of unsurpassed ugliness." Ten years later, in a hearing on his nomination to be Nixon's solicitor general, he said had been wrong about the civil rights legislation.

Of the many Southern Democrats still in the Senate in 1986, by then dependent on significant African-American support at the polls, only Sen. Ernest Hollings of South Carolina voted for Bork.

Edwin Meese, who was Reagan's attorney general at the time, was a leading proponent of counteracting what he saw as liberal judicial excesses, characterized most vividly by the Warren court, by making judges of people like Bork and Scalia.

"The vicious opposition by the left to Bob Bork's nomination turned what had sometimes been a contentious confirmation process into literally a political campaign," Meese said Wednesday.

The wrangling over nominees, once confined to the Supreme Court, now affects even candidates for district court judgeships. And nominees, looking back at Bork's performance, now routinely duck questions intended to elicit politically damaging responses that might provide a reason for senators of one party or the other, to cast "no" votes.

The Senate eventually rejected Bork's nomination 58-42, with the help of a half-dozen Republicans who joined all but two Democrats in voting against him.

In later years, Bork joked that he achieved a measure of immortality anyway, because his name became a verb signifying the vilification of a nominee on political grounds, as in, to Bork a nominee.

After the Senate vote, the Reagan administration said it would nominate Douglas Ginsburg, but that choice faltered over Ginsburg's admission that he had smoked marijuana while a professor at Harvard Law School.

He withdrew and the White House put up Kennedy, who was confirmed without a dissenting vote and whose ongoing role as the swing vote in many of the cases that split the justices on ideological grounds remains a source of consternation among conservatives.

UMass student death challenges university's right to restrict - Poynter.

On Nov. 16, Sydne Jacoby, a sophomore at the University of Massachusetts was walking with a group of friends near campus when she tripped and fell just before midnight. It?s a pretty well-traveled street for party revelers on a Friday night and Amherst officials would later confirm that alcohol was involved in the accident.

Three days later, Jacoby died from injuries suffered in the fall.

Yet, it wasn?t until 10 days later, in a story in The Daily Hampshire Gazette, that the university community and larger Amherst community were informed of the death.

In that initial report, UMass spokesman Edward Blaguszewski said?Jacoby was not identified by university officials based on the wishes of her family and privacy considerations. And in this case the university also chose not to send around an e-mail announcing the student death ? standard operating procedure since I began teaching here five years ago.

My first thought: What else don?t we know? Is it legitimate for university officials to withhold information from the public based on privacy concerns?

Blaguszewski said the decision to hold back information on the Jacoby death was a ?balancing of interests? between the public?s right to know and the family?s right to privacy.

?It?s not uncommon to not send out an email with a student death,? said Blaguszewski.? ?It?s happened many times when students have died.?

The journalistic purpose of reporting on deaths

As a journalist, there are few stories more difficult to cover than the death of a young person. Making the call to get comments from the family is never an easy task. Yet we do it because it is part of the mission of journalists to get information ? good and bad ? out to the public. We tell the stories of the living and the dead. And when young people die under tragic circumstances, we report and write in the hopes that the story may do some good.

?I was surprised that the university bowed to the family?s request,? said Larry Parnass, the editor of the Daily Hampshire Gazette.

?I felt there is an information need to be served. I wonder how they?ll handle future incidents. Can any family put a stop to news of legitimate interest to the entire UMass community by citing privacy? Under what circumstances does community interest override that??

Deaths on university campuses are sensitive. Students have rights, but on public campuses such as the University of Massachusetts the public has a right to know if students are dying ? and how they are dying. In this case, many private efforts were made to help students, yet where were the public efforts?

In this case, university officials privately contacted housing staff, faculty members and others impacted by Jacoby?s death to make sure they were aware of counseling services. Yet, in deciding not go to public with its information, university officials violated the social contract it has with its community.

?The UMass community has a right to know when it loses one of its members,? said Karen List, director of the UMass Journalism Program.? ?It?s important to mark every student?s passing in that way?and a disservice to all of us not to do it.?

There has?always been a certain amount of tension between journalists and the world of officialdom. At a public university it gets even trickier as officials balance the public?s right to know with putting the best face on the university. And, in a news environment that now includes Facebook, Twitter and citizen journalists, it?s rare that information doesn?t get out. In the Jacoby case, The Gazette did not publish her name because the only confirmation of her identity and the role of alcohol came from social media.

?We believe in putting sources on the record,? said Parnass. ?The best that we got from UMass news office was that there had been a death and the school had not notified the community at the family?s insistence.?

Information wants to be shared

Social media kicked in days after The Gazette?s report came out when citizen journalist Larry Kelley posted Jacoby?s name on his blog ?Only In the Republic of Amherst,? and questioned why the university had not been more forthcoming in releasing information surrounding the tragedy, asking whether the role of alcohol played a part in the silence.

?Obviously alcohol played a role in this terrible tragedy,? wrote Kelley. ?Obviously UMass doesn?t want people to know that. Question is who ? or what ? are they trying to protect??

Student journalists at The Massachusetts Daily Collegian used Facebook when conducting their reporting. Senior journalism student Katie Landeck reported the story for The Collegian and was able to find Alison Lynch, a friend who was with Jacoby that night, through Facebook.

The story was not an easy one for Landeck to report. She hesitated in calling the family, knowing their desire for privacy. But, she did it anyway. In the end, The Collegian reporters and editors thought of the public?s right to know and published what they knew.

?The thing is?alcohol?was a contributing factor and therefore the detail that she had been drinking is important to the story, and it was the big question everyone was going to ask themselves, so I felt it had to be in there,? said Landeck.

?It?s my job to answer those questions. But the most important thing, and [the] thing that drove this story for me, is that I don?t think the fact that she was drinking when she fell should rob her of her identity. She should be remembered by the UMass community as Sydne Jacoby, not just the drunk girl who tripped.?She deserved a name, a face and for her story to be told, and I didn?t want to further punish her by denying her that.?

In the end, the attempt to control the flow of information by the family and the university ended up bringing more attention to Jacoby?s death. It?s not the first time we?ve seen that happen. That?s why transparency is usually the better course. But, what I?ve found on this campus (and others) is a shocking lack of media literacy. University officials and faculty truly do not understand how the media operates or what information is public ? or should be.

These restrictive behaviors are the last thing we should be seeing on university campuses. University officials at UMass and elsewhere would be well-served to conduct annual media training sessions and seminars for faculty and administrators.

On college campuses, where the exchange of ideas is valued, so should the free flow of information.

iTunes video shop rolling out across Apple's new territories

Last week, Apple announced iTunes was coming to 56 new territories. Sadly, from that rather sizable list, only Russia, Turkey, India and South Africa launched with movie rentals and purchases in place. Now the lights are coming on in other countries as well. Reports are that a grand total of 42 new territories now have access to a selection of feature films, including some from Disney and Sony. Patriots back on top of AP Pro32 power rankings

NEW YORK (AP) ? See ya, Houston. Tom Brady and the New England Patriots have taken over the top spot in the AP Pro32 NFL power rankings.

Hours after routing the previous No. 1 Texans 42-14, the Patriots were back on top of the rankings for the first time since Week 2. Houston held the No. 1 spot for a month before tumbling to fourth following its second loss of the season.

Peyton Manning and the Denver Broncos are second, with the San Francisco 49ers third as they prepare to visit New England on Sunday night.

The Patriots (10-3) received 11 of 12 first-place votes and 383 points Tuesday in balloting by The Associated Press' panel of media members who regularly cover the league. Denver (10-3) got the other first-place vote and had 369 points.

"That was quite a message they sent to the league Monday night, said ESPN's Chris Berman of the Patriots' seventh straight win.

"The Patriots played a near flawless game and are taking form to make a serious run at the Lombardi," said Fox Sports' John Lynch. "A potential Super Bowl preview awaits Sunday night with the 49ers."

The Broncos, meanwhile, take an eight-game winning streak into their game against Baltimore, which fell into a tie for eighth after an overtime loss to Washington.

"Peyton Manning is making his pitch for a record fourth NFL MVP award. He has steered Denver to eight consecutive victories and thrown 19 TD passes during that stretch," said the Dallas Morning News' Rick Gosselin, the only voter who had Denver No. 1 this week.

The Atlanta Falcons dropped two spots to fifth after their loss to Carolina, and Green Bay and the New York Giants were tied for sixth.

Even at 11-2, voters are beginning to wonder about the Texans, who have clinched a playoff spot but still have two more games against division rival Indianapolis, ranked 10th this week.

"The hope is that Monday's loss (by Houston) was a wakeup call," said Clark Judge of CBSSports.com. "If not, make it the beginning of the end to what once looked like a promising season."

As for the Falcons, their second loss has some voters wondering as well.

"Has any 11-2 team every gotten as little respect? Don't think so," said The Sporting News' Clifton Brown, who ranked the Falcons eighth.

Seattle made the biggest advance after its 58-0 rout of Arizona, up four places to eighth.

"It's like Pete Carroll is back at USC beating up on Washington State. Seahawks absolutely pummel Cardinals 58-0, only 11 points from equaling Carroll's most lopsided win in college," said Newsday's Bob Glauber.

Jacksonville is 32nd and last.

Who's living past 100 in the U.S.? Mostly white women

WASHINGTON (Reuters) - Women have long been known to live longer than men, but when it comes to hitting the century mark the difference is stark: just 2 out of 10 Americans who live to 100 or longer are male.

Of the 53,364 Americans age 100 and older, more than 80 percent are women, a U.S. Census Bureau report released on Monday showed.

The agency's findings, based on data collected from its 2010 census, also found those who make it past 100 are also more likely to be white city-dwellers in the Northeast and Midwest.

"Due to sex differences in mortality over the lifespan, the proportion of females in the population increases with age. This is especially true in the oldest ages, where the percentage female increases sharply," Census researchers wrote.

"For every 100 centenarian females, there were only 20.7 centenarian males," they added.

While reaching 100 years of age may not attract as much fanfare as it did a few decades ago, the public still marvels at those who reach "super centenarian," status.

Guinness World Records, which certifies the oldest living person, said the title was held by Besse Cooper, an American woman who died last week at age 116 in a Georgia nursing home soon after having her hair done.

Guinness announced on its website that the new person to certified to be the oldest anywhere on the globe is 115-year-old Dina Manfredini, an immigrant from Pievepelago, Italy, who has lived in Des Moines, Iowa, since 1920. She is just 15 days older than Japan's Jiroemon Kimura, Guinness World Records said.

Although still rare, the number of people living past 100 can have an impact as policymakers consider and plan services and programs that affect older adults, Census said in its report.

The findings are not necessarily all rosy for women.

Living longer can mean greater medical and retirement expenses, among other issues.

And the number of those living past 100 continues to grow. Just 32,194 Americans reached 100 or older in 1980, far below the current level, according to the Census Bureau.

Still, centenarians in the United States remain relatively rare compared to those in other developed countries.

There were 1.73 centenarians per 10,000 people in the United States in 2010 compared to 1.92 per 10,000 people in Sweden, 2.70 per 10,000 in France and 3.43 per 10,000 people in Japan, Census said.

NEW YORK (AP) ? The mtvU network is honoring a rap superstar who detailed his love for another man and a Pakistani girl shot for her education advocacy as its Man and Woman of the Year.

Frank Ocean, who earned six Grammy nominations Wednesday, published a letter online about his first love, a man, just as his "channel ORANGE" disc was being released. MtvU on Thursday called it "an incredibly brave move for an artist on the verge of superstardom."

Fifteen-year-old Malala Yousufzai (mah-LAH'-lah YOO'-suf-ZAY') blogged about her support of education for girls in Pakistan. For that, Taliban militants stormed her school bus and shot her in the head and neck, but she survived.

The mtvU network is geared toward college students and is seen on more than 750 campuses.

Members of the United Nation?s International Telecommunications Union (ITU) have agreed to work towards implementing a standard for the Internet that would allow for eavesdropping on a worldwide scale.

At a conference in Dubai this week, the ITU members decided to adopt the Y.2770 standard for deep packet inspection, a top-secret proposal by way of China that will allow telecom companies across the world to more easily dig through data passed across the Web.

According to the UN, implementing deep-packet inspection, or DPI, on such a global scale will allow authorities to more easily detect the transferring and sharing of copyrighted materials and other protected files by finding a way for administrators to analyze the payload of online transmissions, not just the header data that is normally identified and interpreted.

?It is standard procedure to route packets based on their headers, after all it is the part of the packet that contains information on the packet's intended destination,? writes The Inquirer?s Lawrence Lati, ?but by inspecting the contents of each packet ISPs, governments and anyone else can look at sensitive data. While users can mitigate risks by encrypting data, given enough resources encryption can be foiled.?

Tim Berners-Lee, a British computer scientist widely regarded as the ?Father of the Internet,? spoke out against proposed DPI implementation on such a grandiose scale during an address earlier this year at the World Wide Web Consortium.

"Somebody clamps a deep packet inspection thing on your cable which reads every packet and reassembles the web pages, cataloguing them against your name, address and telephone number either to be given to the government when they ask for it or to be sold to the highest bidder?? that's a really serious breach of privacy,? he said.

Blogger Arthur Herman writes this week for Fox News online that the goal of the delegates at the ITU ?is to grab control of the World Wide Web away from the United States, and hand it to a UN body of bureaucrats.?

?It?ll be the biggest power grab in the UN?s history, as well as a perversion of its power,? he warns.

The ITU?s secretary general, Dr. Hamadoun I. Toure, has dismissed critics who have called the proposed DPI model invasive, penning an op-ed this week where he insists his organization?s meeting in Dubai poses ?no threat to free speech.?

?It is our chance to chart a globally-agreed roadmap to connect the unconnected, while ensuring there is investment to create the infrastructure needed for the exponential growth in voice, video and data traffic,? Dr. Toure claims of the conference, adding that it presents the UN with ?a golden opportunity to provide affordable connectivity for all, including the billions of people worldwide who cannot yet go online.?

Despite his explanation, though, some nation-states and big-name businesses remain opposed to the proposal. The ITU?s conference this week has been held behind closed doors, and representatives with online service providers Google, Facebook and Twitter have been barred from attending.

In a report published this week by CNet, tech journalist Declan McCullagh cites a Korean document that describes the confidential Y.2770 standard as being able to identify "embedded digital watermarks in MP3 data," discover "copyright protected audio content," find "Jabber messages with Spanish text," or "identify uploading BitTorrent users."

Human rights report names names in Kashmir, invokes international law

Two prominent human rights groups in India-administered Kashmir Thursday accused New Delhi of institutionally blocking justice in thousands of cases of crimes like enforced disappearance, killings, rape, and torture allegedly committed by its forces in the disputed region during the past two decades.

A report "Alleged Perpetrators: Stories of impunity in Jammu and Kashmir" released by the groups analyzes 214 cases and for the first time names 500 specific perpetrators including 469 military, paramilitary, and police officials besides 31 government-backed militants and associates.

The report, which took two years to prepare by International People?s Tribunal for Human Rights and Justice in Indian-administered Kashmir, or IPTK, and the Association of Parents of Disappeared Persons, paints a grim climate of impunity under which Indian forces are operating in the territory controlled by India and also claimed by Pakistan. ?

?Beyond naming the alleged perpetrators, the report explains that the Indian state has not failed but succeeded in its policy of maintaining control [over the disputed region] through absolute impunity accorded to perpetrators of crimes,? says Kartik Murukutla, an author of the report who has worked in a UN tribunal on Rwanda for five years.

Residents of the Kashmir Valley and?resistance?leaders opposed to Indian rule of the region have long accused the Indian government of using its institutions to meet the ends of control rather than address issues of justice and political rights.?

In a shift in strategy, armed rebellion against Indian rule has been largely replaced with massive rock throwing street protests since 2008, but India has not countered with meaningful legal reforms or political initiatives.

Analysts say this latest report adds urgency to calls for an international legal intervention by bodies like the International Criminal Court (ICC) as well as movement toward a political resolution for the long-running Kashmir dispute.??This report should be sent to the prosecutor of ICC who can take suo moto cognizance on the basis of the evidence of war crimes and crimes against humanity it contains and persuade the court for proceedings on the subject,? says Professor Sheikh Showkat Hussain, who teaches international law at the Central University here.

Two Major Generals, three Brigadiers, and more

The accused perpetrators include two major generals and three brigadiers of the Indian Army, besides nine colonels, three lieutenant colonels, 78 majors, and 25 captains. A recently retired director general of police and a serving inspector general are also named along with 37 senior officials of the federal paramilitary forces.

The 354-page report contains significant evidence against the government forces? personnel named but notes that any institutional or political will was absent for ?a trial where the crime and the guilt of a perpetrator can be proven beyond reasonable doubt.?

The Armed Forces Special Powers Act, an emergency military law extended to Kashmir in 1990 in the wake of a full blown armed rebellion against Indian rule, requires New Delhi?s permission for prosecuting federal armed forces personnel accused of crimes like extra-judicial murder. Egyptian leader's opponents, supporters clash

CAIRO (AP) ? Egyptian President Mohammed Morsi's supporters and opponents have clashed outside the presidential palace in Cairo, pelting each other with rocks and fighting with sticks.

Wednesday's clashes began when thousands of Islamist supporters of Morsi descended on the area around the palace where some 300 of his opponents were staging a sit-in.

The opposition wants Morsi to rescind decrees giving him near unrestricted powers and shelve a dispute draft constitution.

Outnumbered by their attackers, the protesters were driven away from their sit-in location outside the palace's main gate and fled to side streets.

No casualties were immediately reported.

Reform leader Mohamed ElBaradei accused the president's supporters of a "vicious and deliberate" attack against peaceful demonstrators.

Drones: A Controversial Eye in the Sky for Property Managers | Zoliath

Many professionals are looking at how UAVs can support their business ventures, including property managers.

This may appear to be a flip side of using essential oils as a mode of treatment for hypertension but in fact, it just reinstates the fact that essential oils are powerful botanical compounds which have a significant impact on the body?s physiological functions.

Reeling Texas cancer agency OK'd faulty $11M award

AUSTIN, Texas (AP) ? Leaders of Texas' embattled $3 billion cancer-fighting effort approved an $11 million grant to a biomedical company even though the proposal wasn't reviewed, according to an internal audit that deepens the troubles of a state agency that has been denounced in recent months by some of the world's top scientists.

The discovery was uncovered during an internal review of the Cancer Prevention and Research Institute of Texas, and its grant to Peloton Therapeutics Inc. in 2010 was among the first it handed out. The Dallas-based company's commercialization award remains one of agency's largest taxpayer-funded grants to date.

The Associated Press on Thursday first reported the audit's findings, which were later announced by the agency.

Tim Kutzkey, Peloton's acting chief executive officer, declined comment and referred questions to CPRIT. In a statement, the agency said the company was unaware that "CPRIT processes had not been followed."

The cancer institute is home to the nation's second largest pot of cancer-research money, behind only the National Institutes of Health, and has awarded nearly $700 million. But it has come under intensifying scrutiny as several scientists, including two Nobel laureates, resigned in protest claiming the agency was charting a new politically driven path that put commercial interests before science.

CPRIT said the internal review did not uncover problems with any other commercialization awards.

The Peloton revelation is the latest blow to CPRIT, which launched in 2009 to widespread acclaim among scientists and cancer survivors but has spent the past year unraveling. Dozens of scientists have resigned from the agency's peer review panels en masse in recent weeks, some of whom criticized the fund for "hucksterism" and "suspicion of favoritism" on their way out the door.

Pelton's application would have been presented to the agency's oversight committee by Jerry Cobbs, the agency's chief commercialization officer. Cobbs announced his resignation this month, and his last day was set for Friday.

Members of the oversight committee are appointed by Gov. Rick Perry and other state elected leaders. The panel has the final say on whether an award is funded, but under agency rules, all applications must be reviewed by an outside panel of peer reviewers who evaluate the scientific and commercial merits of the proposal.

The agency's statement did not explain how Pelton's application made it through the process without anyone noticing that a review never took place. It only said that Cobbs "improperly included" the proposal in a slate of other recommendations to the oversight committee in 2010.

Attempts by the AP to reach Cobbs were not immediately successful Thursday evening.

Bill Gimson, the executive director of CPRIT who vowed that his reeling agency would recover from the growing onslaught of criticism at its annual conference in October, said in response to the audit's findings that the agency must have the state's trust.

"We proactively initiated this comprehensive review in the effort to be transparent and ensure good stewardship," Gimson said.

Peloton's funding has been halted and the company's application is undergoing a second review, the agency said.

According to Peloton's most recent annual report to the CPRIT, which was obtained by AP, the company has attracted $18 million in outside investments since it was founded in 2010 by Steven McKnight, chairman of the biochemistry department at the University of Texas Southwestern Medical Center.

"Peloton Therapeutics aims to become a leading oncology company through the discovery and development of superior therapeutics, delivering extraordinary value to its employees, investors, and ultimately, cancer patients," according to the company's application summary.

CPRIT ? started behind a push led by cancer survivor Lance Armstrong and Perry ? spent most of its first five years basking in praise and industry awe of the unprecedented amount of taxpayer dollars committed to a state-run, cancer-fighting effort. But those plaudits abruptly gave way to rebukes starting in May, and the fissures came from within.

Dr. Alfred Gilman, the agency's chief scientific officer and a Nobel laureate, announced his resignation following a $20 million award that never received a full scientific review. The money was for a so-called incubator project at M.D. Anderson Cancer Center in Houston, one of the country's top research institutes.

Gilman accused the agency's oversight board of ramrodding the project through the application process, despite the proposal being just six pages long. Gimson has said the type of proposal didn't require a full scientific review under agency rules but has since conceded missteps in how that award was handled.

In wake of the Peloton findings, CPRIT announced it would institute new rules that require independent third parties to make sure grant review policies are followed. The agency said it will install a compliance certification process that will accompany every recommended proposal given to the oversight committee.

Facebook and Zynga revamped terms of a years-old partnership that was widely viewed as giving Zynga preferential treatment on the world's No.1 online social network, according to regulatory filings from the two companies Thursday.

The agreement is seen as a move by Facebook to level the playing field between Zygna and other game makers the social network is trying to attract.

The new terms give Zynga more flexibility to offer games on its own website, but subjects the maker of FarmVille and other popular social games to the same rules as other game makers on the social network.

The two fast-growing social Internet companies, which went public within seven months of each other, have been intimately tied. In recent quarters, fees from Zynga contributed more than 15 percent of Facebook's total revenues.

The revised agreement allows Facebook to develop its own games, according to a filing by Zynga on Wednesday. A person close to Facebook said the company "was not in the business of building games and we have no plans to do so."

Both Internet players have been trying to reduce their inter-dependence, with Zynga starting up its own Zynga.com platform, and Facebook wooing other games developers.

Among the myriad terms of their new agreement, Zynga could elect not to use Facebook's payments mechanism to collect revenue or display Facebook's ads.

"We have streamlined our terms with Zynga so that Zynga.com's use of Facebook Platform is governed by the same policies as the rest of the ecosystem," a spokesman said in a statement. "We will continue to work with Zynga, just as we do with developers of all sizes."

Leveson Report: UK Tabloid Behavior Leads to Reform Call - World ...

Indigo/Getty Images(LONDON) -- For years British tabloids have brazenly -- and profitably -- invaded the lives of the famous and the fallen in search of sensational headlines. Today they may finally have to accept the consequences for what is being called "press behavior that, at times, can only be described as outrageous."

After a yearlong inquiry into newspaper wrongdoing, Lord Justice Brian Leveson is calling for an independent media regulatory body to help wipe out a media subculture of unethical behavior.

"There has been a recklessness in prioritising sensational stories, almost irrespective of the harm the stories may cause and the rights of those who would be affected," Leveson wrote in his final report. He wrote that the harm inflicted on innocent people has been "devastating."

His recommendations walk a careful line that tries to impose a regulatory framework without impeding press freedom. Leveson is careful to ensure that politicians and bureaucrats play no role in press regulation. He wants a new body that is much more effective than Britain's current Press Complaints Commission, which is widely seen as a failure.

"What is needed is a genuinely independent and effective system of self-regulation," Leveson wrote. "The ball moves back into the politicians' court: They must now decide who guards the guardians."

The inquiry was set up after revelations of widespread illegal phone hacking by Rupert Murdoch's now-defunct News of the World. Despite years of complaints from celebrities and public figures, it wasn't until the Millie Dowler revelations that the rot in tabloid culture was finally confronted.

Millie Dowler was a 13-year-old English school girl who disappeared in March 2002. She was found murdered six months later. Last year it was revealed that News of the World reporters had been hacking into her voicemails while she was missing, giving her parents false hope that she was alive. The outrage that followed led to the establishment of the Leveson Inquiry.

Witnesses included J.K. Rowling, author of the Harry Potter books, and movie star Hugh Grant. They and many others complained of relentless intrusiveness from the tabloids.

Editors insisted that phone hacking was the work of a few rogue reporters, but the illegal activities were so widespread that Leveson concluded it "was far more than a covert, secret activity, known to nobody save one or two practitioners of the 'dark arts.'"

Leveson was also highly critical of the close relationship of politicians and media bosses. Among the former Murdoch employees charged in a separate police investigation are Prime Minister David Cameron's ex-spokesman Andy Coulson and the prime minister's close friend Rebekah Brooks, who was editor of the News of the World.

Dozens of civil cases against the Murdoch media empire have been settled out of court for millions of dollars.

DHAKA, Bangladesh (AP) ? Amid the ash, broken glass and melted sewing machines at what is left of the Tazreen Fashions Ltd. factory, there are piles of blue, red and off-white children's shorts bearing Wal-Mart's Faded Glory brand. Shorts from hip-hop star Sean Combs' ENYCE label lay on the floor and are stacked in cartons.

An Associated Press reporter searching the factory Wednesday found these and other clothes, including sweaters from the French company Teddy Smith, among the equipment charred in the fire that killed 112 workers Saturday. He also found entries in account books indicating that the factory took orders to produce clothes for Disney, Sears and other Western brands.

Garments and documents left behind in the factory show it was used by a host of major American and European retailers, though at least one of them ? Wal-Mart ? had been aware of safety problems. Wal-Mart blames a supplier for using Tazreen Fashions without its knowledge.

The fire has elevated awareness of something labor groups, retailers and governments have known for years: Bangladesh's fast-growing garment industry ? second only to China's in exports ? is rife with dangerous workplaces. More than 300 workers there have died in fires since 2006.

Police on Wednesday arrested three factory officials suspected of locking in the workers who died in Saturday's fire, the deadliest in the South Asian country's less than 35-year history of exporting clothing.

Local police chief Habibur Rahman said the three will be questioned amid reports that many workers trying to escape the blaze had been locked inside. He said the owner of the factory was not among those arrested.

The three officials were arrested Wednesday at their homes in Savar, the Dhaka suburb where the factory is also located. Rahman did not identify the officials or give their job status.

About 1,400 workers worked at the plant, some 70 percent of them women. Most are from the north, the poorest region of Bangladesh.

Workers who survived the fire say exit doors were locked, and a fire official has said that far fewer people would have died if there had been even one emergency exit. Of the dead, 53 bodies were burned so badly they could not be identified; they were buried anonymously.

The fire started on the ground floor, where a factory worker named Nasima said stacks of yarn and clothes blocked part of the stairway.

Nasima, who uses only one name, and other workers said that when they tried to flee, managers told them to go back to their work stations, but they were ignored.

Dense smoke filled the stairway, making it hard to see, and when the lights went out the workers were left in total darkness. Another worker, Mohammad Rajib, said some people used their cellphones to light their way.

"Everyone was screaming for help," Nasima said. "Total chaos, panic and screaming. Everyone was trying to escape and come out. I was pulling the shirt of a man. I fainted and when I woke up I found myself lying on the road outside the factory.

"I don't know how I survived."

Rajib said the factory conducted a fire drill just three days before the fire broke out, but no one used the fire extinguishers. "Only a selected group of workers are trained to use the extinguishers. Others have no idea how to use them," he said.

The AP reporter who examined the factory Wednesday saw dozens of fire extinguishers with tags indicating they were inspected early this month. Many appeared unused.

Workers expressed support for the factory owner, Delwar Hossain. Rajib said he is "a gentle man" who heeded workers when they protested for more pay and against rough behavior by some managers.

"He took action and fired some of them," he said. "He did not sack any worker. He told us: 'You are my people. If you survive, I will survive.'"

Most the fire's devastation took place on the second and third floors. Sewing and embroidery machines and tables burned to ashes, ceiling fans melted and floor and wall tiles were broken, apparently because of excessive heat. Thick black ash covers everything in the upper floors of the eight-story building.

Much of the clothing on the lower floors was incinerated. Nightgowns, children's shorts, pants, jackets and sweat shirts were strewn about, piled up in some places, boxed in others. Cartons of kids' hooded sweaters, off-white with red and black print, were marked "Disney Pixar."

There were also at least four register books listing buyers including Wal-Mart, Disney, Sears and other companies. Also listed was Li & Fung, a Hong Kong-based buying house that is among the biggest suppliers of garment products from Bangladesh. Li & Fung issued a statement Monday saying it placed orders at the factory for just one company, Kids Headquarters, and that the value of those orders totaled just $111,000.

Prime Minister Sheikh Hasina and Interior Minister Muhiuddin Khan Alamgir have said arson is suspected. Police say they have not ruled out sabotage.

Wal-Mart had received an audit deeming the factory "high risk" last year, said it had decided to stop doing business with Tazreen, but that a supplier subcontracted work to the factory anyway. Wal-Mart said it stopped working with that supplier on Monday.

Calls made to The Walt Disney Company and to Sears Holdings were not immediately returned.

Local TV reports said about 3,000 garment workers held protests over the fire Wednesday, blocking roads and throwing stones at some factories and vehicles. It was the third straight day of demonstrations, and as they did previously, factories in the area closed to avoid violence.

Police used batons to disperse the protesters, but no injuries were immediately reported.

According to local television, most factories in the area closed after opening briefly because of the protests ? a common tactic to avoid violence.
