Wal-Mart suspends India staff in corruption probe

(AP) ? Wal-Mart's Indian joint venture said Friday it has suspended several employees as part of an internal corruption investigation, another blow to the U.S. company's plans for aggressive expansion in a giant market that is largely untapped by foreign retailers.

Bharti Walmart, Wal-Mart's joint venture with India's Bharti Enterprises, said it had suspended "a few associates" and was "committed to conducting a complete and thorough investigation." India's Economic Times newspaper reported that the company's chief financial officer was among the five employees suspended, a claim the company declined to verify.

The news comes at a sensitive time for foreign retailers in India, where corruption scandals in everything from telecommunications to coal mining have badly damaged the ruling Congress Party. Eager to rekindle foreign investment, the Congress Party eased foreign investment rules in September, paving the way for Wal-Mart and others ? which had been limited to wholesaling ? to run retail shops with a local partner.

When parliament reconvened this week, opposition politicians quickly shut down proceedings to protest the move, which has already cost the Congress Party a key coalition partner.

In a Nov. 15 filing to the U.S. Securities and Exchange Commission, Wal-Mart said it was investigating potential violations of the U.S. Foreign Corrupt Practices Act in Brazil, China and India, among other markets. Wal-Mart's Mexico subsidiary is already embroiled in a public scandal over alleged payments to middlemen to speed up the store-opening process, possibly through payments to local officials.

Wal-Mart told the SEC it had spent $99 million in the nine months to October on corruption investigations and related lawsuits and said that it is cooperating with ongoing Department of Justice and SEC investigations.

Indian authorities are also reportedly investigating Wal-Mart for possible violations of foreign investment rules, relating to a $100 million investment in a company owned by its wholesale joint-venture partner, Bharti Enterprises.

Bharti Walmart said Friday that it was in compliance with all Indian foreign investment laws.

"All procedures and processes have been duly followed and details filed with relevant Indian government authorities, including the Reserve Bank of India. The central government has sought certain information and clarification which has been provided by us," the company said in a statement.

Wal-Mart operates 18 wholesale shops in India through its joint venture, according to its website. Wal-Mart said in September that it planned to open retail stores in India over the next 18 months, but the corruption investigation may slow its aggressive expansion strategy.

Spokeswoman Arti Singh said Wal-Mart remains "committed to the Indian market."

"We remain excited about the opportunity to grow our business in one of the world's most vibrant economies, expand opportunities for farmers and help lower the cost of living for families in India," she said by email.

Higgs boson is too saintly and supersymmetry too shy

HOPES of using the Higgs boson and the elegant theory of supersymmetry as shortcuts to discovering the mysteries of the universe are evaporating fast. That's the verdict of a major update from the Large Hadron Collider in CERN, near Geneva, Switzerland - the first since a boson resembling the Higgs was spotted there earlier this year.

"If our understanding of nature is correct, then the details of what happens next are more complicated than we had hoped," says Matthew Walker of CMS, one of the major LHC detectors.

In July, when CMS and its sister detector, ATLAS, announced the discovery of the boson, anomalies in the data hinted at physics beyond the standard model, the well-established description of the universe's particles and forces.

Such new physics is urgently needed because the standard model contains no mention of dark matter, makes incorrect predictions about the universe's antimatter and requires awkward "fine-tuning" to incorporate the Higgs mass reported in July.

The Higgs isn't searched for directly, but spotted via a slew of particles that the standard model predicts it decays to. One anomaly in July's particle debris was insufficient tau leptons, which could have implied the existence of non-standard particles (see "diagram").

But on 14 November, armed with twice as much data, CMS and ATLAS researchers told the Hadron Collider Physics Symposium in Kyoto, Japan, that the number of taus has crept up, removing the hint of deviant physics. CMS also reported a signal suggesting that the boson behaves the same when viewed in a mirror, giving it the property of positive parity, which the standard model also predicts.

There's still one anomaly left. In July, the newly discovered boson seemed to decay twice as often as predicted into pairs of photons, which could be the signature of an extra, non-standard particle, or of a non-standard Higgs. If that anomaly disappears too, the probable Higgs boson will look very standard indeed, which is strange because of all the known possible extensions to the standard model, none predicts a completely standard Higgs.

One explanation could lie in a theory called the Neutrino Minimal Standard Model (nuMSM), in which dark matter is actually a neutrino and the Higgs behaves so similarly to the standard model that the differences would be unobservable. Instead nuMSM might be discovered via space-based detectors that look for its proposed dark-matter particles, but it's a long shot. Just because it seems to fit right now doesn't mean nuMSM is the most plausible scenario, says Raymond Volkas of the University of Melbourne, Australia.

As if the boson's good behaviour wasn't frustrating enough, the LHC's searches for particles predicted by supersymmetry (SUSY)Movie Camera have turned up nothing. As SUSY - which proposes a heavier superpartner for each known particle - extends the standard model to include dark matter and other omissions, this failure deals a further blow to possible sources of new physics at the LHC. It is also stoking exchanges between SUSY supporters and sceptics (see "SUSY no-show fuels debate").

SUSY particles could show up at the higher LHC energies scheduled for 2014, after its year-long planned rest next year. But that is cold comfort to those hoping to have gleaned clues already. "I would, as a hunter of new physics, have liked to see it different to what we have now," says Albert De Roeck of CMS. "But the data is the data."

SUSY no-show fuels debate

Does a lack of evidence for supersymmetry at the LHC (main story) count against this elegant extension to the standard model?

"SUSY's plausibility is reduced," says Nobel laureate Steven Weinberg, "but not to zero." Others say the theory is flexible; that the latest results merely help to whittle down a list of possible incarnations.

Still the results have stoked a debate about the attention SUSY gets. "The theory, specifically as something we would observe at the LHC, was wildly over-promoted," wrote Matthew Strassler from Rutgers University in New Jersey on his blog.

That might have led other promising theories to suffer, says Raymond Volkas of the University of Melbourne, Australia, as popular theories can reduce interest in others. "Many people feel they have to work on the bandwagon ideas."

Michael Peskin of Stanford University in California disagrees. "I think that the serious effort given to SUSY is appropriate," he says, adding that SUSY is attractive because its predictions can be tested. Perhaps only time will tell, but if SUSY eludes the next round of searches in 2014, it will become much harder to test.

Rights groups dismayed by Afghanistan's return to executions

KABUL (Reuters) - Human rights groups reacted with dismay on Wednesday to Afghanistan's resumption of executions after a near-four-year moratorium on a penalty that characterized the austere rule of the former Taliban regime.

Eight men found guilty of "crimes against the people, especially women and children" were hanged on Tuesday and eight more were to meet the same fate either on Wednesday or Thursday, according to a government official.

This alarmed activists who said the return of executions in a country with a weak judiciary was a setback.

"The death penalty is an act of cruelty that should never be used," said Brad Adams, Asia director at the New York-based Human Rights Watch.

"Its use in Afghanistan, where a fair trial is typically out of the question, is even more horrific."

Those executed included a man who strangled to death a mother and her two infant children and men found guilty of kidnapping, raping and murdering young boys and girls.

Officials said that in accordance with the law, President Hamid Karzai signed off on the executions. There have been only two executions in Afghanistan in the past four years.

"The eight hangings in a single day are a terrible step backwards for Afghanistan. President Hamid Karzai should stop future executions and commit to a formal moratorium," Adams said.

Rafi Ferdous, a spokesman for Afghanistan's Council of Ministers Secretariat, defended the hangings.

"By applying this (penalty), the rule of law is implemented. This is a lesson to be learned," Ferdous said in a statement.

EXECUTIONS RARE

Executions were commonplace during the Taliban's strict 1996-2001 rule of Afghanistan, when adulterers and murderers were shot dead in public. Such executions still take place in some areas under the influence of the Taliban.

But judicially sanctioned executions have been rare since the Taliban government fell, with unofficial moratoriums between 2001 and 2004 and from 2008 until recently.

The death by firing squad of 15 prisoners in Kabul in 2007 and several more executions in 2008 sparked international condemnation. Until Tuesday, only two people had been put to death in the past four years.

In a strongly worded statement, London-based Amnesty International suggested Karzai's decision to approve the executions was for his own political gain, to prove his government could maintain law and order.

It said the death penalty was deplorable and described Afghanistan's legal system as "seriously flawed".

"Detainees are frequently tortured into confessions then relied upon by a judiciary that has little to no independence," it said. "There is simply no guarantee of a fair trial."

Hussain Ali Moin, an investigator with Afghanistan's Independent Human Right Commission, said that although the death penalty was legal, there were concerns about whether courts had been fair to those who were executed.

"The death penalty is an irreversible punishment," he said. "We haven't had full access to these cases... Still we cannot say if their trials were fair."
